Eighth Circuit Rejects PhRMA Full Review in Drug Discount Suit

The Eighth Circuit declined to rehear a case from a top pharmaceutical industry group challenging an Arkansas law that prohibits drugmakers from refusing to supply discounted drugs to certain pharmacies.

The US Court of Appeals for the Eighth Circuit on Thursday rejected a petition from the Pharmaceutical Research and Manufacturers of America for rehearing en banc and rehearing by the panel. The drug lobby group in April asked the appeals court to review its decision after it held that Arkansas’ Act 1103 is not preempted by federal law.
