Louisiana’s Covid-era emergency care law validly shields health-care providers from liability for negligence alleged to have occurred during the pandemic, a state appeals court said.
The provision, which is part of the Louisiana Health Emergency Powers Act, doesn’t violate the due process or open courts sections of the state constitution, the Louisiana Court of Appeals, Fifth Circuit, said Thursday.
Louisiana is one of several states that sought to relieve pressure on health-care providers during the Covid-19 pandemic by broadly shielding them from liability for conduct that occurred during the declared health emergency.
