A Kentucky nursing home will face trial in a negligence and wrongful death suit stemming from its treatment of a patient’s surgical wound during the Covid-19 pandemic, a state appeals court said.
Signature Health Care at Jefferson Place Rehab & Wellness Center, a nursing home operated by LP Louisville Herr Land LLC, wasn’t entitled to immunity from suit or damages under either Kentucky law or the federal Public Readiness and Emergency Preparedness Act, the Kentucky Court of Appeals said May 24. The court affirmed the denial of Jefferson Place’s motion for summary judgment, clearing the case for trial.
