Guam Abortion Ban Stays Blocked as Appeals Court Denies New Look

Guam’s attorney general failed to convince a federal appeals court Tuesday to reconsider his unsuccessful bid to vacate a 1990 order blocking the territory from enforcing a near-total abortion ban, which had been found invalid before Roe v. Wade was overturned.

Judges John B. Owens and Roopali H. Desai of the US Court of Appeals for the Ninth Circuit voted against rehearing the case, which they had dismissed as moot following a Guam Supreme Court ruling that territorial lawmakers had implicitly repealed the provision that Guam’s attorney general was attempting to revive through the federal suit.
