A Florida hospital won’t have to turn over quality of care files or referral logs because they fell within a federal privilege for patient safety work product, a US judge said.
Records sought by a wrongful termination plaintiff didn’t qualify for an exception to the federal Patient Safety and Quality Improvement Act’s work product privilege, Judge William F. Jung said Tuesday, after considering new arguments and privately reviewing the requested files.
