A Florida doctor can’t force her former employer to turn over all the records in a database the hospital uses to collect information about medical mishaps, the Eleventh Circuit said.
The Patient Safety and Quality Improvement Act’s “patient safety work product” privilege likely protected the information sought by Tara Loux in an employment-related action against BayCare Medical Group, the US Court of Appeals for the Eleventh Circuit said Tuesday. The appeals court ordered District Judge William F. Jung to withdraw an order that gave Loux access to documents held in BayCare’s electronic rlDatix database.
