Dueling Abortion Pill Rulings Ripe for Supreme Court Fight (1)

Two federal judges with conflicting opinions on whether abortion pills can be sold through the mail are setting up a potential showdown at the US Supreme Court, legal analysts say.

At issue are the judges’ interpretations of the Comstock Act, a 150-year-old federal law banning certain items from being sold through the mail.

US District Judge Robert C. Chambers of the Southern District of West Virginia essentially ruled recently that the Comstock Act doesn’t apply to GenBioPro Inc.'s sale of its generic version of abortion pill mifepristone.
