Generic mifepristone maker GenBioPro Inc. on Tuesday successfully resisted an effort by West Virginia officials to dismiss its lawsuit over the state’s near-total abortion ban.
Judge Robert C. Chambers of the US District Court for the Southern District of West Virginia denied motions to toss out the case over arguments of lack of standing filed by the state’s attorney general and Putnam County’s prosecuting attorney.
The defendants had argued that GenBioPro, which supplies the majority of the abortion pill mifepristone used in the US, failed to show a concrete injury from the state’s abortion law.
