CVS Infants’ Pain Reliever Buyers Drop Appeal in Pricing Suit

Two customers who sued CVS Pharmacy and Perrigo Co. over infants’ pain reliever marketing and pricing have voluntarily dropped their appeal of a ruling that dismissed their consumer claims, according to a Ninth Circuit docket entry.

Brian Youngblood and Priscilla Herrera alleged CVS-brand over-the-counter infants’ acetaminophen manufactured by Perrigo contains the same medicine in the same concentration as a less expensive product marketed for children. The companies misled parents into thinking that infants can’t safely use the cheaper “children’s” formulation, they alleged.
