CVS, Perrigo Get Another Infants’ Pain Relief Suit Dismissed

CVS Pharmacy and Perrigo Co. exited another proposed class action alleging consumers are deceived into thinking infants can’t safely use less expensive “children’s” pain reliever, after a California federal court said federal labeling law bars the claims.

Brian Youngblood alleged CVS-brand over-the-counter infants’ acetaminophen manufactured by Perrigo contains the same medicine in the same concentration as a less expensive product marketed for use with children.

But the disclosure he seeks, that the products can be used interchangeably, is barred because it would impose requirements that federal regulations don’t mandate, the U.S. District Court for the Central District of California said ...
