Court Trims XPO Retiree Suit Over Health Plan Tobacco Charges

XPO Inc. must face claims that it breached its fiduciary duties by charging workers a smoker penalty and failed to provide notice of its tobacco charges or a method for employees to get reimbursements.

The transportation and warehousing company can’t be held liable for violating its health-care plan terms, the US District Court for the District of Connecticut said in a Tuesday opinion partially granting the company’s dismissal bid.
