A doctor acquitted of murdering patients by giving them excessive doses of opioids and benzodiazepines can’t proceed with a malicious prosecution suit against the hospital that made the accusations, a federal court said.
William Husel didn’t timely file a second complaint against Columbus, Ohio’s Trinity Health Corp. after the first had been dismissed, the US District Court for the Eastern District of Michigan said Monday. The new complaint was futile anyway, Judge Jonathan J.C. Grey said, because Husel didn’t properly plead the elements of his claim.
