KBR’s $8 Million Iraq Recovery Withstands Subcontractor Appeal

Kellogg Brown & Root International Inc. will retain its $8 million recovery in a dispute with First Kuwaiti Trading & Contracting W.L.L., KBR’s subcontractor under an Iraq logistics contract with the US Army, the Fourth Circuit affirmed Tuesday.

A Virginia federal district court properly exercised its authority to confirm KBR’s arbitration award, and correctly determined that First Kuwaiti’s motion to vacate the award was untimely, Judge Nicole G. Berner of the US Court of Appeals for the Fourth Circuit said.
