CACI Fails to Upend Detainees’ $42 Million Jury Award (1)

CACI Premier Technology Inc. failed to convince an appeals court to throw out a $42 million verdict for detainees abused at Abu Ghraib prison in Iraq in 2003 and 2004.

CACI didn’t show that the overseas-nature of the conduct required dismissing the suit under the Alien Tort Statute, the US Court of Appeals for the Fourth Circuit said Thursday in a split decision. The ATS gives federal courts jurisdiction to hear certain actions from noncitizens.

“We affirm the jury’s verdict in full,” Senior Judge Henry F. Floyd wrote, joined by Judge Stephanie Thacker.
