The Army Corps of Engineers can move forward with a Florida roadway expansion project, a federal judge ruled, adopting the recommendation of a magistrate judge who found that an environmental group couldn’t prove that the agency unlawfully issued a Clean Water Act Permit.
The Sierra Club alleged in a lawsuit that the corps failed to fully study the project’s environmental effects, which could result in “permanent impacts to high quality preserved wetlands.” The agency’s issuance of the permit to Pasco County violated the Clean Water Act and the National Environmental Policy Act, the group said.
