Sierra Club Drops Illinois Coal Plant Clean Air Act Lawsuit (1)

The Sierra Club agreed to voluntarily dismiss its legal challenge against Prairie State Generating Co. LLC claiming it ran its Illinois coal-fired power plant without a Clean Air Act operating permit since 2012.

The Delaware-based company applied for the permit from Illinois’ Environmental Protection Agency in 2010 but never received one, the lawsuit alleged. The facility’s continued operation led to tens of millions of tons of carbon dioxide and hundreds of tons of particulate matter being emitted in violation of the Clean Air Act, the Sierra Club told the US District Court for the Southern District of Illinois.
