The Tenth Circuit on Thursday clarified a previous order that had vacated a $6 million jury award against a biogas company in a breach of contract case, by allowing nearly $900,000 in damages to stand.
The appellate court partially granted a petition for rehearing from organic recycling service Lambland Inc. by noting that the jury’s $868,000 diversion damages verdict could remain.
