An organic recycling service had a $6 million jury award against a biogas company undone by a federal appeals court Wednesday, after it said that the district judge improperly admitted evidence of lost profits.
The US Court of Appeals for the Tenth Circuit said Judge Raymond P. Moore violated a federal rule of evidence by allowing recycler Lambland Inc.‘s CFO Travis Bahnsen to testify.
“He based his testimony on his professional experience and financial expertise, not particularized knowledge obtained through his six months” working for the company, Judge Joel M. Carson III said for the Tenth Circuit panel.
