EPA Asks Court for 30 Days to Finish PFAS Superfund Rule Review

The EPA asked a federal appeals court on Friday to give the agency’s new leadership more time to conclude their review of a rule making two PFAS hazardous substances under Superfund.

The Environmental Protection Agency filed a motion to the US Court of Appeals for the District of Columbia Circuit asking for a second abeyance, or pause, in the case brought by the US Chamber of Commerce and six other trade associations.

The industry groups are challenging a first-of-its-kind rule the agency issued last year under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), or Superfund law.
