PFAS Superfund Liability Rule Must Be Reversed, Industries Say

A federal court must vacate the PFAS Superfund rule, because the EPA didn’t provide a rationale for selecting covered chemicals and the cost-benefit analysis is fatally flawed, industry groups said in their opening regulatory challenge.

The US Chamber of Commerce led a coalition of six other trade groups from varied industries that filed their opening brief on Monday.

They asked the US Court of Appeals for the District of Columbia Circuit to vacate the Environmental Protection Agency’s rule designating two PFAS—perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS)—as hazardous substances covered by the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), ...
