The US Supreme Court must resolve jurisdiction questions in a Colorado city’s climate lawsuit before massive liability can be imposed on the energy industry, according to a reply brief filed Tuesday.
Justices have the jurisdiction to review the questions presented in this case, which center on longstanding arguments over whether federal law preempts cases that bring climate nuisance and misinformation claims, energy industry attorneys said in the brief.
The city and county of Boulder, Colo., told justices that picking up the case while it continues to proceed through state court would only yield “dead ends.”
