Boulder Urges Supreme Court to Reject Energy Industry’s Petition

The US Supreme Court does not have jurisdiction to review preemption questions brought by oil and gas companies embroiled in climate litigation, according to an opposition brief filed by the city and county of Boulder, Colo.

Exxon Mobil Corp., Suncor Energy Inc., and other major oil companies want justices to review a decision from the Colorado Supreme Court that allows Boulder’s climate tort lawsuit to proceed, which companies say would be an overreach of state powers.
