A consent decree requiring the EPA to review its hazardous air pollutant rules will result in the agency stripping away a protection that oil and gas facilities have used to defend themselves, according to one of the litigants.
The plaintiffs alleged that the Environmental Protection Agency failed to meet deadlines under Section 112 of the Clean Air Act, which requires the agency to review and potentially revise air toxics rules. The reviews are supposed to occur around every eight years, but deadlines are often missed, prompting advocates to sue to get the reviews done.
