Oil Companies’ Win in Delaware Climate Case Vulnerable on Appeal

Oil companies scored victories from a Delaware judge this month for the first time in years of ongoing climate litigation, but they face an appeal that could set back some of their wins.

Delaware is part of a coalition of cities, states, and counties that have levied lawsuits against energy companies over allegations that they lied about how their products fuel the climate crisis. Brought by state Attorney General Kathy Jennings (D) in 2020, Delaware’s case is one of multiple that have made it back to state courts after yearslong federal court jurisdiction battles.
