A Michigan federal court doesn’t have jurisdiction to hear a challenge to the revival of the state’s Palisades Nuclear plant, the Nuclear Regulatory Commission argued.
The Atomic Energy Act and Hobbs Act say a challenge to a licensing action is “limited to the federal courts of appeals,” the government said in its motion to dismiss filed Feb. 27 with the US District Court for the Western District of Michigan.
Beyond Nuclear and other groups in November launched two separate lawsuits against the NRC and Holtec Decommissioning International LLC to stop the Palisades plant from being restored.
