Juliana Youth Lose Supreme Court Bid to Revive Climate Case (1)

The US Supreme Court refused to grant a mandamus request from youth plaintiffs of the landmark climate lawsuit Juliana v. US, dimming hope of the case getting another day in the courtroom.

Justices on Tuesday denied the bid, which asked that the high court reverse and correct the “abuse of rules” from a lower court decision to dismiss the case for lack of standing.

Since 2015, a group of 21 young people have been petitioning judges to hold the US government liable for alleged Constitutional violations caused by rampant fossil fuel development.

A panel at the US Court of Appeals for the Ninth Circuit denied the youth plaintiffs in 2020 and again in May, when it ruled that the case did not have standing and needed to be dismissed by Oregon district court.

The case has spanned over three presidential administrations, and is likely on the path to a final end with Tuesday’s Supreme court denial. The youth do, however, have until Dec. 9 to file a petition for a writ of certiorari to justices.
