Four Lawsuits Against EPA’s Asbestos Rule Head to Fifth Circuit

The federal Judicial Panel on Multidistrict Litigation has selected the US Court of Appeals for the Fifth Circuit to oversee four lawsuits challenging the EPA’s rule that will phase out ongoing uses of chyrsotile asbestos.

The selection of the Fifth Circuit from among the three courts in which industry, labor, and health groups filed their litigation was random, the panel said in Tuesday’s order.

Other cases were filed in the Eleventh Circuit and D.C. Circuit.
