Kentucky won its bid to put the EPA’s traveling ozone rule for the state on hold while circuit judges proceed with litigation against the agency’s “good neighbor” regulations.
The procedural win on Wednesday for Kentucky stops the implementation of a rule that disapproved 21 state air plans that address wandering emissions. The Environmental Protection Agency denied the state plans when it finalized updated Good Neighbor standards that tackle cross-boundary ozone pollution.
