EPA Urges Supreme Court to Block Bid to Freeze Power Plant Rule

State and industry critics of the Biden administration’s take on power plant carbon limits don’t meet the requirements needed to freeze the case while they fight it in court, according to a brief filed by the EPA on Monday.

The Environmental Protection Agency—tasked by Chief Justice John G. Roberts Jr. with responding to a recent emergency stay request—argues that the challengers looking to overturn the rule likely won’t win the underlying case and don’t successfully establish how the agency exceeded its Clean Air Act authority.
