EPA Pushes Back Against Denka Request to Delay Chemical Rules

Chemical manufacturing company Denka Performance Elastomer LLC won’t be harmed if new carcinogenic chemical rules proceed, according to a reply brief submitted by the EPA on Tuesday.

Denka, in its legal war against synthetic organic chemical manufacturing standards, asked a federal appeals court to freeze the rule while litigation proceeds, claiming that the 90-day compliance period under the standards is unfeasible.

Denka’s stay motion doesn’t actually argue that the company is likely to win on the merits of its claims against the rule, nor does it prove that it will be irreparably harmed if the rule moves forward, according to ...
