DOJ Asks Justices to Deny Attempts to Circumvent Climate Cases

Energy industry and state attempts to seek US Supreme Court review of climate deception suits should be denied, the Justice Department argued in two briefs filed on Tuesday.

The responses are the second and third filed by the Biden administration that address petitions filed by Sunoco LP, Alabama, and other states and companies to have a thicket of climate misinformation lawsuits reviewed by the high court.

Justices asked Solicitor General Elizabeth Prelogar in June and October for federal thoughts on two petitions that challenge climate suits writ large and a decision from Hawaii’s Supreme Court.
