Court Pauses Suit Over EPA Rule Adding Two PFAS to Superfund

A lawsuit challenging the EPA’s rule adding two specific PFAS to the list of chemicals covered by Superfund is pending under a court order issued Monday.

The US Court of Appeals for the District of Columbia Circuit paused the case at the Environmental Protection Agency’s request, directing the agency to file by April 25 motions to govern future proceedings.

The pause gives the agency’s new leadership time to craft its legal strategy regarding two regulations based partly on scientific conclusions the previous administration reached about the chemicals.
