A federal appeals court has denied the EPA’s latest attempt to narrow litigation challenging six drinking water limits the agency set for PFAS.
The US Court of Appeals for the District of Columbia Circuit Thursday denied without explanation the Environmental Protection Agency’s February motion to sever and pause litigation against four of the six per- and polyfluoroalkyl substances (PFAS) the agency regulated.
The order marks the second time the DC Circuit has denied the Trump administration’s request to avoid litigation over the four PFAS the agency now deems unlawful.
