A federal appeals court denied the Trump administration’s request to vacate limits the EPA previously imposed on four PFAS in drinking water.
The Environmental Protection Agency asked the US Court of Appeals for the District of Columbia Circuit to vacate four out of six drinking water limits the agency set under former President Joe Biden in 2024 for per- and polyfluoroalkyl substances (PFAS).
The court said Wednesday “the merits of the parties’ positions are not so clear as to warrant summary action.”
The court also set a briefing schedule, with final briefs due in early March.
