Coca-Cola Seeks to End Case Claiming PFAS Found in Simply Juice

The Coca-Cola Company argued a plaintiff has exhausted his chances to sufficiently allege its Simply Tropical brand juice contains PFAS, a family of “forever chemicals” known to be harmful to humans and the environment.

The beverage giant told the US District for the Southern District of New York that plaintiff Joseph Lurenz’s latest complaint contains “even vaguer” allegations than a previous amended suit the court dismissed in June. Coca-Cola, in a letter requesting a conference before filing a pre-motion to dismiss, argued the suit should be dismissed entirely, without leave to amend.
