Environmental groups’ challenge against a clay manufacturer over allegedly discharging pollutants, including stormwater, from its clay recycling facility into Temescal Creek, the Santa Ana River, and the Pacific Ocean can continue, a federal court said.
Orange County Coastkeeper and its program Inland Empire Waterkeeper sued Corona Clay Co. in 2018 for the alleged discharge without proper permitting, in violation of the Clean Water Act.
The US Supreme Court declined Corona’s request to hear the case in April 2022, after a Ninth Circuit decision vacated a jury verdict in favor of the company and remanded for further proceedings.
