Army Corps Surface Mining Water Permit Voided by Federal Court

Environmental groups won their bid to toss an allegedly unlawful Clean Water Act permit from the US Army Corps of Engineers for Republic Energy’s surface coal mining project in West Virginia.

“The Corps’s decision to issue the permit to Republic was arbitrary and capricious,” said Judge Robert C. Chambers of the US District Court for the Southern District of West Virginia on Tuesday.

Coal River Mountain Watch, Appalachian Voices, West Virginia Highlands Conservancy, and the Sierra Club sued the Corps in 2025, claiming the agency’s environmental analysis for the Turkeyfoot Surface Mine in Raleigh County, W.Va. was defective. ...
