Arizona Largely Defeated in Challenge to Biden Border Policies

The Biden administration can avoid most of Arizona’s lawsuit over its border policies because the state failed to show a connection between those policies and increased migration or harm to wildlife, a federal judge in the state ruled.

Arizona challenged the end to border wall construction, the end to the Trump-era “remain in Mexico” policy, and other decisions by the Department of Homeland Security. The federal government failed to review the effects of its policies as required by the National Environmental Policy Act, the state told the U.S. District Court for the District of Arizona.
