Algonquin Gas Transmission LLC can operate its natural gas compressor in Massachusetts while the state completes its environmental review of the project, the First Circuit said Monday after reweighing the issue and the winter ahead.
The U.S. Court of Appeals for the First Circuit previously vacated the Massachusetts Department of Environmental Protection’s air permit issued for the Weymouth compressor station.
The court said in its June decision that the department didn’t follow its own procedures when it found that Algonquin was using the best available technology to reduce emissions.
