Cornell Retirement Suit Sent to District Court After SCOTUS Trip

A long-running lawsuit over Cornell University’s retirement plan will return to a federal district judge after the US Supreme Court’s worker-friendly decision reviving the dispute, the Second Circuit announced.

The Second Circuit on Wednesday sent the case back to district court after reviewing briefs in which the parties disagreed about how the lawsuit should proceed. On remand, the district court can consider whether to set a briefing schedule for summary judgment motions, whether to reopen discovery or decide the case on the existing record, and whether the workers are entitled to a jury trial on their claim for prohibited transactions ...
