Cornell, Workers Spar Over Retirement Plan Row Revived by SCOTUS

Cornell University and employees who scored a US Supreme Court victory reviving litigation over their retirement plan disagree about whether the dispute should return to district court or be resolved by the Second Circuit.

The workers advocated to the US Court of Appeals for the Second Circuit on Tuesday for a jury trial and further consideration of their prohibited transactions claim under the Employee Retirement Income Security Act, while Cornell opposed a jury trial and said the claim must fail given how other aspects of the case were resolved.
