Wayfair Workers Waited Too Long to Add State Claims to Wage Case

Wayfair LLC customer service workers can add new plaintiffs to their two-year-old wage lawsuit, but it’s too late to add new state-law claims, a federal judge said.

The workers asked to amend their 2023 complaint to add purported violations of the wage laws of eight new states. But they “unreasonably delayed” in adding those claims in a way that “unduly prejudices” the furniture retailer, which faces the same claims in a separate suit filed last month in the same court, the US District Court for the District of Massachusetts said in an opinion docketed Friday.
