Ulta Dodges Retail Worker’s California Pay, Breaks Suit, for Now

Ulta Salon, Cosmetics & Fragrance Inc. won its bid to dismiss a proposed class action alleging it forced retail employees to work through meal and rest breaks and shorted them on overtime and sick pay, a federal judge in California ruled.

Plaintiff Dorcas-Cothy Kabasele didn’t “identify even one specific occasion” when she was denied a full meal or rest break in her complaint, Judge William B. Shubb of the U.S. District Court for the Eastern District of California said Wednesday.
