Transco Again Unable to Keep Natural Gas Case From State Board

Transcontinental Gas Pipe Line Co. on Monday lost its bid to convince the Third Circuit that a challenge to the company’s natural gas project permits at a Pennyslvania state agency was preempted by federal law.

The company raised nearly identical arguments as in previous stages of the litigation, but the panel’s analysis of those arguments hasn’t changed. That means the lower court’s dismissal was appropriate, Judge Cindy K. Chung wrote on behalf of the US Court of Appeals for the Third Circuit.
