SpaceX’s Lawsuit Against Labor Board Stays in Texas, For Now

SpaceX’s constitutional challenge to the National Labor Relations Board had its transfer to a California federal court canceled again after a Texas federal judge rescinded his order that would have sent the case westward.

Judge Rolando Olvera, an Obama appointee to the US District Court for the Southern District of Texas, said Monday that the court’s clerk “erroneously entered” his May 17 order that doubled-down on his original February directive that the case belongs in the Central District of California.

Olvera said he’s awaiting input from the US Court of Appeals for the Fifth Circuit.
