Sixth Circuit Upholds NLRB Order to Reopen Shipping Facility

A shipping and transportation company must reopen a Kentucky facility after a federal appeals court ruled it shuttered the terminal over the workers’ organizing campaign.

Quickway Transportation Inc. violated federal labor law by closing a Louisville, Ky., plant to stop the drivers from unionizing, the US Court of Appeals for the Sixth Circuit held Wednesday.

The ruling enforces a 2023 National Labor Relations Board mandate on the issue. The case is one of several within the past year in which the NLRB required employers to reopen shuttered locations, and Wednesday’s decision strengthens the board’s ability to order those kinds ...
