Reynolds Fails to Flip Altria’s $95 Million Vape-Patents Verdict

British American Tobacco Plc’s R.J. Reynolds Vapor Co. failed to shed a North Carolina jury’s $95.2 million verdict finding its Vuse Alto e-cigarette infringes three Altria Group Inc. vape-pod patents, as an appeals court rejected Reynolds’ challenge.

Circuit Judge Sharon Prost, writing for a three-judge panel in a nonprecedential opinion issued Thursday in the US Court of Appeals for the Federal Circuit, affirmed the district court’s denial of Reynolds’ motions for a new trial, for a judgment on damages, and to exclude apportionment testimony, concluding the evidence and methodology used were supported by the record.
