Proposed Rule on Worker Eligibility Verification Under Review

The White House is reviewing regulations that would grant companies flexibility for processing workers’ employment verification forms.

The Department of Homeland Security is proposing to allow alternative document examination procedures for Form I-9 review, according to a notice of proposed rulemaking posted by the Office of Information and Regulatory Affairs Tuesday (RIN 1653-AA86). The agency has waived requirements that employers inspect those documents in person during the Covid-19 pandemic in workplaces that were operating remotely, most recently extending that flexibility through the end of October.
