The National Labor Relations Board is trying to revive its rule for joint labor law liability by appealing a federal district court’s decision nixing the agency’s measure.
The NLRB on Tuesday filed a notice that it is challenging the district court’s March decision at the US Court of Appeals for the Fifth Circuit, a court dominated by Republican judges and known for rulings critical of federal regulatory agencies.
