Justices Pass on California Truckers’ Worker Classification Spat

The US Supreme Court declined to take up an employer challenge to a federal appeals court decision that federal law doesn’t override state regulations making it difficult to classify workers as independent contractors.

The dispute, which the justices turned down Thursday, centers on California’s Assembly Bill 5, a codified version of a 2018 California Supreme Court decision requiring employers in the state to apply a three-part “ABC test” to determine whether a worker is an employee entitled to job benefits or an independent contractor who isn’t.
